The Moscow City Court cancelled the arrest of Tamerlan Eskerkhanov, the third accused of the murder of the politician Boris Nemtsov, and remitted the case for a new trial concerning the measure of restraint for him.
This was reported by RIA “Novosti”. “The decision is connected with the wish to observe the rights of the accused for protection” – the press secretary of the Court Ulyana Solopova stated. She recalled that the Plenum of the Supreme Court of the Russian Federation recommended that the courts should take individual decisions when selecting measure of restraint for several defendants in one case, since each of them may have his/her own circumstances.
Earlier, on April 1 the Moscow City Court made a similar decision regarding Shagit Gubashev and Khamzat Bakhaev. All five defendants were charged with the Part 2 of the Article 105 of the Criminal Code (“Murder committed by a group of persons by prior agreement or by an organized group based on motives of political, ideological, racial, ethnic or religious hatred”). They were detained on March 7-8 during a special operation in Ingushetia and in Moscow Oblast, and then on March 8 they were arrested by a court decision. Another alleged participant of the group, Beslan Shavanov, blew himself up with a grenade on March 7 during an attempt of his arrest in Grozny.
The “version associated with the Islamic extremist trace” is also considered: Nemtsov “was threatened in connection with his position regarding the shooting of the journalists of the magazine Charlie Hebdo in Paris”. In addition, the crime could be related to the inner conflict in Ukraine, as well as commercial activities of Nemtsov or someone’s personal dislike towards him.
